Snow drop community care complies with Privacy Data Protection Act 2014 (VIC), the Privacy Act 1988 (Cwth), the Health Records Act 2001 (VIC), and the general protections for the right to privacy contained in the Charter of Human Rights and Responsibilities Act 2006 (VIC).

Personal Information and reason of collecting the personal Information

Personal Information is the information or opinion, which identifies a person. Some examples of Personal Information collected by us include: names, phone numbers, email addresses and addresses.

Your Personal Information is collected by us in several ways, which includes interviews, by email, by telephone, correspondence, and though our website www.XXXX.com, from third parties and other available sources publicly.

Snow drop community care will request as well as retain Personal Information only when it is needed to:

  • Offer a responsive and safe and service;
  • Assess if you are eligibility for the service;
  • Monitor a services that is being provided by us; and
  • Fulfill the contractual requirements in order to provide the non-identifying data as well as statistical information to funding bodies.

The videos and photographs are also considered Personal Information under the privacy legislation. Therefore, we will take photos or make videos after taking voluntary and full consent.

The Personal Information will be collected after explaining to you the need of collecting it and how are we planning to use the information.

Sensitive Information

Sensitive Information is the kind of Personal Information, which is the opinion about a person’s ethnic or racial origin, philosophical or religious beliefs, political opinions, a membership of any political association, membership of the trade union or any other professional body, criminal record, sexual practices or preference. The sensitive Information consists of Health Information that is an opinion or information about the mental, physical, or psychological health or the ability of a person.

Sensitive Information is only used by us:

  • for the main purpose for which the information was needed; or
  • for the secondary purpose, which would be directly related to the main purpose; and
  • after taking consent; or where it is required or is authorized by the law.

Third Parties

Where practicable and reasonable to do so, Snow Drop Community Care will collect your Personal Information from you only. However, in few circumstances we might get the information from third parties (like other disability support services). In this case, we will take some reasonable steps to make sure that you are aware of the information that is being provided to us by third parties.

Information Disclosure

The Personal Information will be disclosed only:

  • for medical emergency or treatment;
  • to other agencies after taking permission from you or your representative;
  • after taking written consent from an individual with lawful authority; or
  • if required by the Commonwealth Law, or for fulfilling legislative obligations like mandatory reporting.

Information Destruction and Security

The Personal Information provided by you is stored in a way that reasonably protects the information from loss and misuse from unauthorized access, disclosure or modification. When the Personal Information is not needed for purposes for which the information was obtained, reasonable steps is taken to permanently de-identify or destroy the Personal Information. The records are retained relating to the provision of services, according with Record Principles 2014 that is for 3 years after 30th June of the record making year. It includes the records of people who are permanently ceased by us to provide support to.

Information Access

You can access the personal information that we have, including for updating or correcting it, which is subject to some exceptions. If you want to access the information we have about you, kindly speak to our customer care member. For protection of your Personal Information, we might need identification to ensure you are requesting the information before releasing it.

You reserve the right to:

  • request an access to the information that we have about you;
  • access the information; as well as
  • make corrections if the information is considered inaccurate, incomplete or not being up to date.

In accordance with Privacy Data Protection Act 2014 (VIC), the access might be denied totally or partially if:

  • the request is vexatious or frivolous;
  • providing access could have unreasonable impact on other individual’s privacy;
  • providing access may prejudice the investigation of any possible activity prohibited by law;
  • providing access may pose an imminent or serious threat to the health or life of any person; and
  • it is authorized or required to deny access under or by law.

Our aim is to address each request of correcting or accessing information within the next two working days. There is no fee for accessing request, but there might be an administrative fee of providing a copy of the personal information to you.

Maintenance of Quality of the Personal Information

It is essential for us to keep your information up to date. We take steps to ensure that the information is complete and accurate. If you get to know that the information is inaccurate or not up to date, kindly tell us as soon as possible so we may update the records and make sure we continue to offer quality services to all of you.

Updates of Policy

Snow Drop Community care Privacy and Confidentiality as well as Information Management Policies, Records and Procedures will formally be reviewed every year. Our formal reviews consist of client, staff as well as feedback from other stakeholder.
